Energy Efficiency

Barringer Leather Lawyers has had a long association with the energy efficiency industry and particularly the performance contracting sector. We have advised industry participants on the establishment of the inaugural industry association, the Australasian Energy Performance Contracting Association (AEPCA) and we are a member of its successor organisation, the Energy Efficiency Council (www.eec.org.au). Greg Leather has been a board member of the association and was closely involved in the drafting of the Association’s national standard suite of contracts. The standard documents include a Detailed Facility Study Agreement and standard Energy Performance Contract. These documents have been endorsed by energy services companies (ESCOs), relevant Commonwealth and State Government departments, and public and private sector facility operators. We also assisted in the preparation of the Best Practice Guide to Energy Performance Contracts and the Best Practice Guide to Monitoring and Verification of Energy Savings. Barringer Leather Lawyers has acted for the industry association, government bodies and ESCOs in relation to performance contracting for over ten years.

Telecommunications

The telecommunications team at Barringer Leather Lawyers has over eight years of experience acting for carriers dealing with the establishment and maintenance of telecommunications facilities on government, commercial and residential buildings and sites. We have extensive experience in drafting access agreements with site owners and operators, negotiating disputes by way of both alternative dispute resolution before the Telecommunications Industry Ombudsman and conducting proceedings in the Supreme and Federal Courts with respect to the placement and maintenance of telecommunication facilities. Our team has a thorough understanding of the statutory powers afforded to carriers, the limits of those powers and how best to apply them in negotiating commercial and cost effective outcomes for our clients.
